Review and Comment on the KSHCP

2-How to Apply

A draft Application Template is posted under the Documents tab of this website. Alternatively, just give the KSHCP office a call and we would be happy to assist you with any questions you may have.

In general each entity that wishes to participate in the KSHCP will submit an “Application” detailing all facilities and activities to be covered, requested take level, and description of avoidance and minimization actions. The Application needs to include a description of existing and future facilities, range of avoidance and minimization measures considered, and the justifications for accomplishing or not accomplishing each. Avoidance and minimization measures and determinations of requested take levels will be discussed with KSHCP staff. The basic steps, some of which may happen simultaneously, include :

  1. Applicant meets with KSHCP staff to discuss KSHCP, permit needs, schedule, and facilities to be covered;
  2. KSHCP staff may provide technical assistance in evaluating covered activities and facilities;
  3. KSHCP Staff provides Applicant with Avoidance and Minimization guidelines and Application Template;
  4. Applicant submits Application detailing Requested Covered Facilities, Regulations pertinent to lights and other structures for which coverage is sought, and commitments/plans to implement avoidance and minimization actions (along with cost and schedule);
  5. Proposal is evaluated by KSHCP/DLNR and USFWS and further discussions with Applicant are held as needed;
  6. Applicant implements site-specific interim avoidance and minimization actions (minimally, between September 15 -December 15) including but not limited to:
    1. Avoid take risk;
    2. Minimize take risk;
    3. Train staff (Worker Seabird Awareness & Response Training WSART);
    4. Monitor facilities during the defined fallout period; and
    5. Outreach (if applicable).
  7. Applicant and KSHCP staff verify implementation of actions agreed to under item 6;
  8. Applicant, DLNR, and USFWS determine appropriate requested take level;
  9. Once KSHCP is completed, Applicant pays fees; and
  10. Applicant receives ITP/ITL and becomes an official Participant of the KSHCP.

 

This process does not detail the formal State and Federal HCP approval processes, but rather, provides general steps that Applicants would follow to become an official KSHCP Participant.

 

 


Stakeholders

Stakeholders are vital to the KSHCP and NEPA Processes. Starting in early 2010 we will be posting opportunities and seeking feedback from Stakeholders in several forums and format.

Meetings for applicants and potental applicants were completed in April and May 2010. These meeting were work group styel designed to review the KSHCP and discuss NEPA Scoping.  Meeting summaries were published and follow up meetings on key topics will be held in the late summer-winter 2010.
